Specific regulation in cases of restructuring

The specific regulation of outplacement under an activating policy in restructuring is applicable only when the employee enjoys the procedure of activating policy in restructuring.

Note: In this situation, the specific regulation of outplacement must be applied in the framework of an activating policy in restructuring, even if the dismissed employee fulfills the conditions to benefit from the general or the specific regulation of outplacement.

The content of the outplacement offer varies according to the employee's age at the time of the announcement of the collective dismissal.

Is the employee:

  • at least 45 years old: then the outplacement offer must meet the conditions, stipulated in Collective Labor Agreement No. 82, for at least the first six months of enrollment in the employment cell. The worker must be able to benefit from at least 60 hours of outplacement (services) during at least the six months he is registered with the employment cell.
  • less than 45 years old: then the outplacement offer must meet the conditions, stipulated in Collective Labor Agreement No. 82, for at least the first three months of enrollment in the employment cell. The worker must be able to benefit from at least 30 hours of outplacement (services) for at least the six months he is registered with the employment cell.

In addition, the law provides for other types of outplacement:

  1. The general system of outplacement;
  2. The specific regulation of outplacement for employees at least 45 years old;
