Specific regulation for employees >= 45 years of age

The specific regulation of outplacement for employees at least 45 years old has a more limited scope. This regulation only applies when: 

  • the employer of the dismissed employee falls within the private sector;
    Note: public sector employers (Federal Government, Regions, Communities, local and provincial administrations,...) and public economic enterprises (SNCB, B-POST and BELGACOM)) are not targeted by the specific outplacement scheme for employees aged at least 45 years; 
  • the employee was not fired for an urgent reason;
  • the employee is entitled to less than 30 weeks' notice or corresponding severance pay; 
  • and he has been continuously employed by the company for at least one year at the time of dismissal. 

In addition, the law provides for other types of outplacement:

  1. The general system of outplacement;
  2. The specific regulation of outplacement in the context of an activating policy in restructuring.
